1. Enrollment & Eligibility

By applying to or participating in the Cinematic AI Films Affiliate Program (“Program”), you (“Affiliate”) agree to be bound by these Affiliate Terms of Service (“Terms”). Cinematic AI Films, LLC (“Company,” “we,” “us,” or “our”) reserves the right to approve or reject any affiliate application at its sole discretion.

2. Independent Contractor Relationship

Affiliates are independent contractors and are not employees, agents, partners, or legal representatives of Cinematic AI Films. Affiliates may not bind the Company to any agreement or obligation.

3. Commission Structure

Affiliates earn commissions based on completed and delivered sales generated through their unique referral links.

• Tier 1: 30% commission (standard affiliates)
• Tier 2: 35% commission (10+ completed sales per month)
• Tier 3: 40% commission (25+ completed sales per month or approved agencies)
• Tier 4: 45% commission (invite-only strategic or white-label partners)

A “completed sale” means the order has been paid for, fulfilled, delivered, and not refunded or charged back during the payout delay period.

4. Payout Timing & Methods

Commissions are paid after a payout delay period (typically 14 days following delivery). A minimum payout threshold may apply. Payments are issued via PayPal, Stripe, or another method designated by the Company.

5. Refunds, Chargebacks & Clawbacks

If a customer order is refunded, disputed, or charged back, any associated commission is void. The Company reserves the right to deduct such amounts from future affiliate payouts.

6. Marketing & Promotion Rules

Affiliates may promote Cinematic AI Films using ethical and lawful methods.

• Permitted: personal outreach, content marketing, organic social media, opt-in email lists.
• Prohibited: spam, unsolicited bulk email, misleading claims, fake testimonials.
• No paid advertising using the Cinematic AI Films brand name without written permission.
• No guarantees or promises of views, leads, conversions, or revenue.

7. Brand Usage

Affiliates may only use approved brand assets provided by the Company. Affiliates may not alter logos, impersonate the Company, or create websites or pages that appear to be official Cinematic AI Films properties.

8. AI-Generated Content Disclosure

All commercials sold through Cinematic AI Films are generated using artificial intelligence based solely on customer-provided inputs. Affiliates must not claim or imply that commercials are custom human-directed or manually produced unless explicitly stated by the Company.

9. Termination

Cinematic AI Films reserves the right to suspend or terminate any affiliate account at any time for violation of these Terms or for conduct deemed harmful to the Company. Upon termination, unpaid commissions may be forfeited if tied to fraud, abuse, or policy violations.

10. Limitation of Liability

To the maximum extent permitted by law, Cinematic AI Films shall not be liable for indirect, incidental, or consequential damages. Total liability shall not exceed the amount of commissions paid to the Affiliate in the preceding three (3) months.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the District of Columbia, United States.
